NOTICE OF PUBLIC HEARING

On Thursday, January 14, 2021 at 6:30 pm the Dunstable Advisory Board will hold a public hearing on two Warrant Articles to be considered at Special Town Meeting on January 28, 2021. The Warrant Articles are as follows:

ARTICLE 1:Route 113 Project Land Acquisitions: To see if the Town will vote to authorize the Board of Road Commissioners to acquire by gift, purchase, or taking by eminent domain, any parcels of real property, permanent easements, and temporary easements, for public way purposes, including without limitation drainage, utility, slope, grading, road realignment, sidewalks, construction of improvements and structures, and other related purposes, as may be necessary to complete the MassDOT Main Street Transportation Improvement Project, said parcels and easement areas being generally shown on a plan entitled “Preliminary Right of Way” dated October 27, 2017, on file in the Town Clerk’s Office and available for public inspection during regular business hours, and as may be amended through final project design; and further to raise and appropriate, transfer from available funds, borrow, or otherwise provide a sum of to be expended for engineering, design, and other associated services, and for the acquisition of said parcels of real property and easements, including but not limited to acquisition costs, the award of eminent domain damages, and related expenses and fees, said sum being the Town’s matching share of the MassDOT Main Street Transportation Improvement Project, or take any action in relation thereto.

ARTICLE 2:Lease of Water Tank for Cellular Equipment: To see if the Town will vote to authorize the Board of Selectmen to lease portions of Town-owned property located at 108 Pleasant Street, Assessors Parcel 17-53-2, and portions of the water tank located on the property, for cellular communications equipment, and grant any access and/or utility easements as may be necessary or convenient to serve the cellular communications equipment, on such terms, conditions, and minimum amounts as the Board of Selectmen determines to be in the best interests of the Town, provided that the Board of Water Commissioners determines that said portions of the property are not required for public purposes, or take any action in relation thereto.
